TERMS & CONDITIONS

Payment terms are 1/2%-10, Net 30. Any invoices outstanding over 30 days will be subject to a monthly finance charge of 1-1/2% per month, compounded on a monthly basis.
All orders are subject to acceptance by seller.
Prices are subject to change without notice. A price increase will be effective immediately for all new orders. Existing orders will be at the lower price if shipped within 60 days from the date of a price increase. A price decrease will be effective immediately on shipments of existing and new orders.
Buyers cannot modify, cancel, or otherwise alter purchase orders after material is in process without our written consent. Any cancellation, modification, or alteration shall be subject to conditions as negotiated at such time and shall include protection of Erie Concrete & Steel Supply Co.
All prices are quoted delivered. Seller may at its option, quote prices on a freight collect basis. Title passes to purchaser when material has been delivered.
SELLER WARRANTS THAT THE GOODS FURNISHED SHALL CONFORM TO STANDARD SPECIFICATIONS. SELLER MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED AND SPECIFICALLY EXCLUDES ALL WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
No claim for any reason will be honored if material has been allowed to get rusty during STORAGE at customer facilities.
No claim for damaged goods that do not conform to specification will be allowed unless seller is given immediate notice after delivery of goods to the first destination to which they are shipped, and allowed opportunity to inspect them. Goods for which damages are claimed require Seller's written consent before being returned, repaired, or discarded.
PURCHASER'S EXCLUSIVE REMEDY AND SELLERS SOLE LIABILITY SHALL BE LIMITED TO SELLER'S REPLACING GOODS THAT DO NOT CONFORM TO SPECIFICATIONS OR, AT SELLER'S OPTION, TO REFUNDING THE PURCHASE PRICE OF THE GOODS. IN NO EVENT SHALL SELLER HAVE ANY LIABILITY FOR DAMAGES IN CONNECTION WITH THE SALE OF GOODS IN AN AMOUNT EXCEEDING THE PURCHASE PRICE OF THE GOODS SOLD AND SELLER SHALL HAVE NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
